I. INTRODUCTION

Zeptem, Corp. is the owner and developer of “7ViX”, an application and user experience that connects riders with providers of services based on the riders age, profile, and preferences. Personal data is collected by Zeptem and we want to make sure you trust and understand why we collect, how we use and share, and how you can manage the data shared with our company. It is important you understand our data privacy practices.  Our data practices are subject to applicable laws in the places in which we operate.  Please contact our legal counsel by email using jalcoba@alcobalaw.com with any questions regarding our practices in a particular country or region. II. OVERVIEW

Privacy Notice Scope

This notice describes how Zeptem collects and uses data and applies to all users globally, unless they use a service covered by a separate privacy policy. 

  • Riders: Individuals who request or receive transportation services through their ZVix account.
  • Drivers: Individuals who provide transportation to Riders or Guest Users individually or through partner transportation companies. 
  • Guest Users: Individuals who receive ride services ordered by other ZViX account holders. friends, family
  • Merchants: Merchants are individuals or companies who advertise their products and services via audio and video marketing materials during the Riders, Guest Users, trip. 

All those subject to this notice are referred to as “users” in this Notice. 

Information Zeptem Collects

The information collected and how the information is used depends on how you use ZVix and how you manage your privacy controls. 

If you are not logged into ZVix, the information we collect is stored in the cloud and or on servers.  This allows Zeptem to maintain your preferences across browsing sessions and facilitates the production of more relevant advertising in the form of audio and video marketing materials generated and submitted by our Merchants for the benefit of our Riders and Guest Users. 

Privacy practices are subject to applicable laws in the places in which we operate. 

For users in the United States:

Florida. Florida enacted the Florida Digital Bill of Rights (FDBR). To qualify as a data controller under the FDBR, an organization must have $1 billion in global gross revenue and satisfy one of the following: Derive 50 percent of its global gross revenue from the sale of advertisements online; Operate a consumer smart speaker and voice command service; or Operate an app store or digital distribution platform with at least 250,000 different software applications. The FDBR provides consumers residing in Florida with the following data privacy rights: 

  • Access rights, including a right to confirm whether the controller is processing any data at all.
  • Correction rights.
  • Deletion rights concerning the data provided by or about the consumer.
  • Data portability rights.
  • Opt-out rights related to the sale of personal information, targeted marketing, and profiling.
  • Opt-out rights related to the collection of sensitive data.
  • Opt-out rights for the collection of personal data through voice recognition features.

Other States and Territories. Zeptem does not currently operate outside of Florida. The everchanging data privacy landscape in the United States will require Zeptem to update its privacy policy to comply with each state that has enacted data privacy rules and regulations. Zeptem will take reasonable steps to update its privacy policy when it expands its services into these additional states and or U.S. territories.

Special Information for EU Users. Zeptem does not currently operate in any European Union Country. Should operations commence, this Privacy Policy will be updated to comply with the General Data Protection Regulation guidelines and laws. 

Our data practices are subject to applicable laws in the places in which we operate. This means that we engage in the practices described in this notice in a particular country or region only if permitted under the laws of those places. Data Controller and Transfer

Zeptem is in its initial stages but expects it will one day qualify and be recognized as the data controller for the personal data collected in connection with use of the Platform or Services in the United States. We currently process personal data inside the United States.

III. DATA COLLECTION AND USES

  1. Data. Safety starts with understanding how we collect and share your data. Data privacy and security practices may vary based on your use, region, and age. We share this information and may update it over time.
  1. Data provided by users
    1. User profile information Including Name, Address, Email address, User IDS, and Phone Number. We may collect this information through various forms and in various places through the Services, including account registration forms, “contact us forms”, or when you otherwise interact with us. When you sign up to use the Services, you create a user profile. 
    2. Children’s Information. We do not knowingly collect personal information from children under the age of 13 without the consent of the child's parent or guardian. We collect what is reasonably necessary for kids to participate on our site. This might include gender and age. This might also include an email address. We collect parents’ email addresses. We may collect this from the child or the parent. We also collect information if your child contacts us. If your child contacts us, we may send the child a one-time response and delete the child’s online contact information from our records promptly after we have sent the response. If your child uses our sites, we may collect information about the browser or network used, device information or user’s IP address. Unless permitted by law, we use children’s information after getting parental consent. We may use email addresses to notify parents or guardians that their children have registered on our site. We may also use your email address to communicate about your child’s account.
    3. Background check information. Drivers are required to input additional information including Vehicle VIN Number  and their Social Security number (Background Check) or Driver License (Motor Vehicle Record) to allow a background check.
    4. Identity verification photos. We also may provide some of your Personal Information (such as your first name and your photo, if you have chosen to upload your photo to your profile) to the advertisers with whom you choose to associate with. Those advertisers, as well as Zeptem, are also able to access your Personal Information, including your geo-location data.
    5. Demographic data. Zeptem may collect demographic data including age, sex, hobbies, lifestyle and location, to match you with advertisers and to otherwise assist you and allow you to utilize or perform the Services, respond to your requests, customize your experience on the Zeptem, site and contact you regarding your account.
    6. Financial Information. Depending on whether you’re a Rider or a Driver, 7vix may require your financial information, such as bank routing numbers, tax information, and any other payment information you provide us to enable usage and 7vix features and services. 
    7. User content. User feedback, such as ratings, feedback, complaints or compliments.
    8. Trip Information. Tracking information is collected as you navigate through our Services, including, but not limited to geographic areas.  For all drivers using our Services, the driver’s mobile phone will send your GPS coordinates, during the commute, to our servers. Most GPS enabled mobile devices can define one’s location to within 50 feet. We collect this information for various purposes – including to determine the amount of money you earn while performing the Services, to provide you with support, to send you promotions and offers, to enhance our Services, and for our internal business purposes. We may also have features that allow you to share this information with other people (such as your family, friends or colleagues) if you choose.  In addition, our advertises can see the GPS coordinates recorded by the driver’s mobile phone for all driving time, as well as certain information about you (such as your name and other Personal Information).
  2. Data created during use of our services
    1. Location Data (drivers, riders, guest users, merchants) May be precise or approximate location information as determined through data such as your IP address, WIFI, and or GPS. With respect to geo-location data we track through your Mobile Device, we use that geo-location information for various purposes – including for you to be able to view the income earned by you in connection with providing the Services, to send you promotions and offers, and to allow you (if you choose through any features we may provide) to share this information with other people. Except as otherwise permitted in this Privacy Policy, we will not share this information with third parties for any purpose and will only use this information for the sole purpose of providing you with the ability to provide the Services. You may at any time no longer allow our Mobile Application to use your location by turning this feature off at the Mobile Device level. The types of location data we collect and how long we store it depend in part on your device and account Settings on your device.
    2. Transaction & Payment information. We collect transaction information (including payment information) related to the use of our Platform or Services, including the type of Services requested or provided, request details, trip information, date and time the Service was provided, amount charged, distance traveled, program selected for viewing/entertainment purposes, and payment method.
    3. Usage Data. We collect data about how users interact with our Platform and Services. This includes data such as access dates and times, App or Site features or pages viewed, App or Site crashes and other system activity, type of browser and third-party sites or services used before interacting with our Platform and Services. In addition, if you visit our Sites, we may collect certain information by automated means, such as cookies and web beacons. The information collected in this manner includes IP address, browser characteristics, device characteristics, operating system, language preferences, referring URLs, information on actions taken on the Sites and dates and times of Site visits. A “cookie” is a text file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. A “web beacon,” also known as an Internet tag, pixel tag. or clear GIF, links web pages to web servers and their cookies and may be used to transmit information collected through cookies back to a web server. Through these automated collection methods, we may obtain “clickstream data,” which is a log of content on which a visitor clicks while browsing a website. As a visitor clicks through our website, a record of the action may be collected and stored. Certain data elements collected through automated means, such as your browser information, may be linked with other information otherwise obtained about you to let us know, for example, whether you have opened an email we sent to you. Your browser may tell you how to be notified when you receive certain types of cookies or how to restrict or disable certain types of cookies. Please note, however, that without cookies you may not be able to use all of the features of our Sites.
    4. Device Data. We may collect data about the devices used to access our Platform or Services, including the hardware models, device IP addresses, operating systems and versions, software, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion data and mobile network data.
    5. Communications Data. Communications data may be collected and shared with third parties if you specifically and knowingly upload to, share with others or transmit to an email recipient, online community, website or to the public through features which may be provided on our Services and may include uploaded photos, posted reviews or comments, or information about you or your ride.
  3. Data from other sources.
    1. Data from other sources could include:
      1. User feedback [ratings, feedbacks, complaints, or compliments]
      2. Users participating in any referral programs.
      3. Account holders who request services for or on behalf of other users, or who enable such users to request or receive services through their accounts.
      4. Users or others providing information in connection with claims or disputes.
      5. Vendors who help us verify users’ identity, background information or eligibility to work, or the authenticity of a user’s request for Services, whether for regulatory, safety or security purposes.
      6. Insurance, vehicle or financial services providers for drivers.
      7. Publicly available sources.
      8. Marketing service providers. You may be presented with an opportunity to receive information and/or marketing offers directly from third parties. If you do agree to have your Personal Information shared, your Personal Information will be disclosed to such third parties and all information you disclose will be subject to the privacy policy and practices of such third parties. We are not responsible for the privacy policies and practices of such third parties and, therefore, you should review the privacy policies and practices of such third parties prior to agreeing to receive such information from them. If you later decide that you no longer want to receive communication from a third party, you will need to contact that third party directly.
    2. Uses of Personal Data
      We collect your personal information or usage information to provide you with an enhanced experience while using the Services. We use your nonpublic personal data to match you with advertisers and to otherwise assist you and allow you to perform the Services, respond to your requests, customize your experience on the Zeptem, site and contact you regarding your account. If you give us permission, we will also use your information to make you aware of additional products and services that may be of interest to you or to contact you regarding site changes.
      1. To provide services. We use the information we collect to customize our services for you, including providing recommendations, personalized content, and customized search results.

        Depending on your settings, we may also show you personalized ads based on your interests. We don’t show you personalized ads based on sensitive categories, such as race, religion, sexual orientation, or health. We don’t share information that personally identifies you with advertisers, such as your name or email, unless you allow us to.
      2. Safety and security. We use the information we collect to maintain and enhance users’ safety and security. If a user has engaged in dangerous or inappropriate behavior using our platform and application, we use the retained data from that user to ban that user to prevent their use of 7vix services.
      3. Customer support. We may use the information we collect to address your concerns to improve our ability to render services through our platform.
      4. Research and Development. We use the information we collect to research and further improve and develop our platform and services.
      5. Enabling communication between users. For example, a driver may message or call a passenger to confirm a pickup location or a passenger may contact a driver to retrieve a lost item. Once the ride is complete, messages will be retrievable by contacting Zeptem’s support by submitting a request through Zeptem’s Contact Us form available online.
      6. Marketing and advertising. You may be presented with an opportunity to receive information and/or marketing offers directly from third parties. If you do agree to have your Personal Information shared, your Personal Information will be disclosed to such third parties and all information you disclose will be subject to the privacy policy and practices of such third parties. We are not responsible for the privacy policies and practices of such third parties and, therefore, you should review the privacy policies and practices of such third parties prior to agreeing to receive such information from them. If you later decide that you no longer want to receive communication from a third party, you will need to contact that third party directly. Users may opt out of receiving marketing and promotional communications from 7vix by following the unsubscribe instructions sent out in those communications. It is possible users may still receive non-promotional communications to users who have opted out of marketing and promotional communications, which could include information about user’s account or receipts related to rides.
      7. Third Party Content. The Services may contain content that is supplied by a third party, and those third parties may collect web site usage information and your Device Identifier when web pages from any online or mobile Services are served to your browser. In addition, when you are using the Services, you may be directed to other sites or applications that are operated and controlled by third parties that we do not control. We are not responsible for the privacy practices employed by any of these third parties. For example, if you click on a banner advertisement or the domain or other controlled application of any advertiser, the click may take you away from our website onto a different web site. These other web sites may send their own cookies to you, independently collect data or solicit Personal Information and may or may not have their own published privacy policies. We encourage you to note when you leave our Services and to read the privacy statements of all third party web sites or applications before submitting any Personal Information to third parties.
      8. Non-marketing communications. Zeptem may use the data collected to generate and provide users with receipts; inform them of changes to policies like Terms of Use, Data Practices and Data Policy; or any other non-proprietary, non-confidential policy generated by Zeptem specifically related to the “7ViX” application and platform.
      9. Legal proceedings and requirements. We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. Thus, we may access, use, preserve, transfer and disclose your information (including Personal Information), including disclosure to third parties such as government or law enforcement officials or private parties as we reasonably determine is necessary and appropriate:
        1. To protect the safety of the public for any reason.
        2. To detect, prevent or otherwise address fraud, security or technical issues.
        3. To prevent or stop activity we may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity. Further, we may use IP address or other Device Identifiers, to identify users, and may do so in cooperation with third parties such as copyright owners, internet service providers, wireless service providers and/or law enforcement agencies, including disclosing such information to third parties, all in our discretion. Such disclosures may be carried out without notice to you.
        4. To satisfy any applicable law, regulation, subpoenas, governmental requests or legal process.
        5. To protect and/or defend the Terms and Conditions for online and mobile Services or other policies applicable to any online and mobile Services, including investigation of potential violations thereof.
        6. To protect the safety, rights, property or security of Zeptem, our services, or any third party.
    3. Cookies and third-party technologies. Cookies may be used to collect usage information. A cookie is a data file placed on a Device when it is used in connection with the Services. A Flash cookie is a data file placed on a Device via plug-ins that may be built in to or downloaded by you to your Device. Cookies and or Flash cookies may be used for many purposes, including, without limitation, remembering you and your preferences and tracking your visits to web pages and applications. Cookies work by assigning a number to the user that has no meaning outside of the assigning website.
    4. Data sharing and disclosure.
      1. With other users. We may share the data we collect with others. The data shared could include riders’ name and pickup and/or drop off location with drivers; riders’ name with other passengers in a shared ride. Passengers in a shared ride may also see the dropoff location of the other passengers. Furthermore, driver information and data with riders and/or account holders; vehicle license plate; vehicle make, vehicle model, vehicle color, and vehicle photo; location (before and during trip); and contact information (depending upon applicable laws). Receipts related to rides and purchases may also be disclosed to third parties.
      2. At the user’s request. This includes sharing data with:
        • Other people at the user’s request. For example, we share a user’s ETA and location with a friend when requested by that user, or a user’s trip information when they split a fare with a friend.
        • Zeptem third parties including but not limited to contractors, providers, and or business partners. Data shared may include, for example, other services, platforms, apps or websites that integrate with Zeptem’s APIs; vehicle suppliers or services; those with an API or service with which we integrate; or restaurant and or shopping partners or other business partners and their users in connection with promotions, contests, or specialized services.
      3. With the general public. Questions or comments from users submitted through public forums such as Zeptem blogs and Zeptem social media pages may be viewable by the public, including any personal data included in the questions or comments submitted by a user.
      4. With the 7ViX account owner. If a user requests Services using an Account held by another party or payment for which Services will be charged to an Account held by another party, we may share the request and/or trip information, including real-time location data, with the Account holder. This occurs, for example, when:
        • A passenger uses their employer’s 7ViX for Business account (or a sub-account thereof) to arrange or pay for a trip via the Platform
        • A driver uses an 7ViX Account held by or associated with a third party transportation company (e.g., a dispatch association, radio network or for-hire vehicle rental company); or
        • A passenger takes a trip arranged by a third party under that third party’s 7ViX Account.
      5. With Zeptem Subsidiaries and affiliates. [Reserved]. As of the date of this Notice, 7ViX does not have subsidiaries and or affiliates.
      6. With Zeptem business partners. We will share your information with a person, business, organization or body using or integrating our Products to advertise, market or support their products and services. These partners may send information about events and products by text, mail or email. When you use our platform or services, you may see ads and sponsored or commercial content by Zvix business partners. Messages you receive from a business could include an offer for something that might interest you. We want you to enjoy your experience and as with all of your messages, you can manage these communications, and we will honor the choices you make.
      7. With Zeptem service providers. We will share information with third parties who perform services on our behalf. For example, we share information with vendors who help us send emails and operate our sites. We also share information with vendors to complete payments or administer a promotion.
      8. With Zeptem clients. Clients are defined as advertisers that participate in 7ViX platform and applications. For example, we might share or sell information with clients who co-sponsor a promotion using our platform or application. These partners may send information about events and products by text, mail or email. When you use our platform or services, you may see ads and sponsored or commercial content by Zvix clients.
      9. Crash logs and diagnostics. We use your Internet Protocol (IP) address to help diagnose problems with our computer server, and to administer our web site(s). Your IP address is used to help identify you, but contains no personal information about you.
      10. Legal reasons or in the event of a dispute. 7ViX may share user’s personal data if we believe it is required by applicable law, regulation, legal or administrative process or governmental request, operating license, or where the disclosure is otherwise appropriate due to safety, fraud, or similar concerns. This includes sharing personal data with law enforcement officials, public health officials, airports (if required by airport authorities as a condition of providing services on airport property) other government authorities or other third parties as necessary to enforce terms of service, user agreements if any, or other policies, to protect 7vix’s rights or property or the rights, safety, or property of others; or in the event of a claim or dispute relating to the use of the App or services. If someone else’s credit card is used to pay for services, we may be required by law to share your personal data, including order or trip information, with the owner of the credit card. Should 7ViX be restructured, require financing, consolidated, sold or enter negotiations for sale, your personal data may be shared with another company or lending institution. To protect the safety of the public for any reason. 7vix may access, use, preserve, transfer, and disclose your information to detect, prevent or otherwise address fraud, security or technical issues; to prevent or stop activity we may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity. Further, 7vix may use IP address or other Device Identifiers, to identify users, and may do so in cooperation with third parties such as copyright owners, internet service providers, wireless service providers and/or law enforcement agencies, including disclosing such information to third parties, all in our discretion. Such disclosures may be carried out without notice to you.
      11. your consent. 7ViX may share a user’s personal data other than as described in this notice if we notify the user and they consent to the sharing.
      12. Automated decision-making. Personal data may be used to make automated decisions relating to the use of our services. This includes but is not limited to:
        1. Deactivating users who are identified as having engaged in fraud or activities that may otherwise harm Zeptem, its users, and/or others.
        2. Using user location information, and communications between Riders and Drivers, to identify no-show or cancellation fees payable or induced through fraud. For example, if we determine by using such information that a driver is delaying a Rider pickup in order to induce a cancellation, we will not charge the passenger a no-show or cancellation fee and may instead charge the driver a no-show or cancellation fee.
        3. Matching available vehicles to users requesting ground transportation. Users can be matched based on availability, proximity and other factors.
    5. Security Practices, Information Retention and Deletion
      1. The Personal Information and Usage Information we collect is securely stored within our databases, and we use standard, industry-wide, commercially reasonable security practices such as encryption, firewalls and SSL (Secure Socket Layers) for protecting your information and geo-location information. However, as effective as encryption technology is, no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that information you supply won’t be intercepted while being transmitted to us over the Internet or wireless communication, and any information you transmit to the Company you do at your own risk. We recommend that you not disclose your password to anyone.
      2. Requests to delete data can be made by submitting a formal request by e-mail to [email account] or by removing your user account and personal related information by performing the following steps: 1) logging into the Zeptem 7ViX mobile application; 2) accessing My Account; 3) Updating Account or Delete Account Option; and 4) Verifying you want to delete the account. This will remove all user data and stored third party data. Data that has already been shared with third parties cannot be retrieved/recovered.
      3. Use of Cookies. If you do not want information to be collected through the use of cookies, your browser and or device allows you to deny or accept the use of cookies. Cookies can be disabled or controlled by setting a preference within your web browser or on your Device. If you choose to disable cookies or Flash cookies on your Device, some features of the Services may not function properly or may not be able to customize the delivery of information to you. You should be aware that Zeptem cannot control the use of cookies (or the resulting information) by third parties, and use of third party cookies is not covered by our Privacy Policy.
      4. Social Media and Widgets. If you click on a link to a third party site, you will be taken to websites we do not control. This includes social media sites. This policy does not apply to the privacy practices of these websites. Read the privacy policy of other websites and insurance carriers carefully. We are not responsible for these third party practices.
      5. Opt out. Advertising and marketing information may be opted out of if you choose to opt out of certain advertising and marketing features. Note, we may send you strictly service-related announcements on occasions when it is necessary to do so. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.

IV. CHOICE AND TRANSPARENCY

Zeptem enables users to access and control the data that Zeptem collects, including through:

  • In-app settings
  • Device permissions
  • Marketing opt-outs

Zeptem also enables users to request access to or copies of their data, changes or updates to their Accounts, deletion of their Accounts, or that Zeptem restrict its processing of user personal data.

A. Privacy settings

Zeptem provides users with trip status notifications and updates related to activity on their account. These notifications are a necessary part of using the Zeptem app and cannot be disabled. However, users may choose the method by which they receive these notifications through the Settings %3e Profile %3e Push Notifications menu in the Zeptem app. Disabling push notifications may limit your ability to use our Services.

A passenger can adjust his or her location-sharing preferences in the settings menus of his or her mobile device. The 7Vix mobile App uses passengers’ device location services to make it easier to arrange a trip whenever they need one and to connect user with promotions offered by third parties in nearby areas during user’s active trip. Location data helps improve Zeptem’s services, including pickups, navigation, and customer support. Disabling Zeptem’s Apps’ access to your device’s location services may limit your ability to use our Services.

B. Device permissions

Most mobile device platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without the device owner’s permission, and these platforms have different methods for how that permission can be obtained. iOS devices notify users the first time the Zeptem app requests permission to access certain types of data and gives users the option to grant or refuse permission. Android devices notify users of the permissions that the 7Vix app seeks before their first use of the app, and use of the app constitutes a grant of such permission.

D. Marketing opt-outs

Users may opt out of receiving marketing and promotional communications from Zeptem by following the unsubscribe instructions in those communications. We may still send nonpromotional communications to users who have opted out of marketing and promotional communications, such as receipts for rides or information about their Account.

E. User data requests

Zeptem provides users with a variety of ways to learn about, control, and submit questions and comments about Zeptem’s handling of their data. To make a request, please send an email to data@zeptem.com and jalcoba@alcobalaw.com. Subject of email should be: Attn: Zeptem Data Practices.

Accessing data: Users can ask for an explanation of the data we collect from them and how we use it.

Receiving data: Users can ask for a copy of data that Zeptem collects from them with their consent or as necessary to provide our services.

Changing or updating data: Users can edit the name, phone number, email address, payment method and photo associated with their account through the Settings menu in Zeptem’s 7Vvix Apps or Sites. They may also ask that Zeptem change or update their data, including if they believe such data is inaccurate or incomplete.

Deleting data: Users may request deletion of their account at any time by submitting such request to delete@zeptem.com.

Objections, restrictions, and complaints: Users may request that Zeptem stop using all or some of their personal data, or that we limit our use of their data. Zeptem may continue to process data after such objection or request to the extent required or permitted by law. In addition, depending on their location, users may have the right to file a complaint relating to Zeptem’s handling of their personal data with the data protection authority in their country.

V. UPDATES TO THIS NOTICE

Updates to this Policy.

This policy may be updated from time to time. Significant changes will be communicated to you by e-mail or SMS. To the extent permitted under applicable law, by using our services after receipt of the notice, you are consenting to the updates of this policy.
